Please read these Terms of Service ("Terms") carefully before using the FitReps AI service. By accessing or using the service, you agree to be bound by these Terms.

Interpretation and Definitions

Interpretation

Words with an uppercase first letter have the meaning set forth below. These terms have the same meaning regardless of whether they are used in the singular or plural form.

Definitions

In the context of these Terms:

Affiliate means any entity that controls, is controlled by, or is under common control with a party, where "control" means having at least 50% ownership in shares, equity, or other voting securities.
Country refers to: Estonia
Company (referred to as "Company," "We," "Our," or "Us" in this Agreement) refers to Milvi, an app development studio located at Roseni 9-5, Tallinn, Estonia.
Device means any device that is capable of accessing the Service, such as a computer, mobile phone, or tablet.
Service refers to the website and mobile application available at fitreps.ai.
Terms of Service (referred to as "Terms") mean these terms that constitute the entire agreement between You and the Company regarding the use of the Service.
Third-Party Social Media Service means any services or content (including data, information, products, or services) provided by a third party and made available within the Service.
Website refers to FitReps AI, which can be accessed at fitreps.ai.
You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Acceptance

These Terms govern the use of the Service and form the agreement between You and the Company. Access to and use of the Service is conditional upon Your agreement to follow these Terms. By using the Service, You agree to these Terms. If You do not agree with these Terms, please do not access or use the Service.

You confirm that You are at least 18 years old. The Company does not permit anyone under 18 to use the Service.

AI, Voice Logging, and Data Usage

By using the Service, You consent to the collection of your workout data, including voice data. The Service uses AI-powered features, such as voice logging and personalized workout recommendations, which analyze your input data (including your spoken logs) to suggest exercises, track progress, and provide insights based on your previous workouts.

Voice Logging

You acknowledge that FitReps AI uses voice recognition to log your workouts by simply speaking your set details (reps, weight, etc.). This feature helps you track your workouts hands-free and with minimal interruption.

AI Coaching

FitReps AI uses machine learning algorithms to analyze your workout history, progress, and performance. The AI makes personalized recommendations and adjusts your workout plan based on your previous activity.

Data Use for AI

Data collected from your workouts will be used to train and improve the AI’s ability to make workout suggestions. By using the Service, you consent to the use of this data to enhance the performance of the AI.

Data Storage & Privacy

All data collected via voice logs and workout tracking will be handled as outlined in our Privacy Policy. Please refer to our Privacy Policy for detailed information on how your data is stored, used, and protected. The Privacy Policy is separate from this document and governs all aspects of data privacy.

Payment and Subscriptions

The Service may offer premium features that require a subscription or one-time payment. The details of these subscriptions or purchases, including pricing, billing cycles, and features included, will be presented to you before subscribing.

By subscribing, You agree to pay the applicable fees for the chosen plan. Subscription fees are non-refundable unless otherwise specified.

Third-Party Services

The Service may include third-party services, such as integration with other fitness apps (e.g., Google Fit, Apple Health) or external devices (e.g., fitness trackers). These third-party services may collect and store your data independently of FitReps AI.

The Company does not control and is not responsible for the content, privacy policies, or practices of these third-party services. You agree that the Company is not liable for any loss or damage caused by the use of these third-party services or reliance on any content, goods, or services available on such services.

We encourage You to read the terms of service and privacy policies of any third-party services that You use in conjunction with FitReps AI.

Termination

We may terminate or suspend your access to the Service immediately, without notice or liability, for any reason, including if you breach these Terms.

Upon termination, all your rights to use the Service will cease immediately.

Limitation of Liability

The total liability of the Company for any claim related to these Terms, whether in contract, tort, or otherwise, is limited to the amount You have paid for the Service or €100, whichever is greater.

The Company and its suppliers are not responsible for any indirect, incidental, special, or consequential damages, including, but not limited to, loss of profits, data, or use, or damage to privacy, even if the Company has been advised of the possibility of such damages.

Service "As Is" and "As Available" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" with all faults and defects without any warranty of any kind. The Company does not guarantee that the Service will be uninterrupted or error-free, or that it will meet your expectations.

Applicable Law

These Terms are governed by the laws of the Republic of Estonia, excluding its conflict of law principles.

Dispute Resolution

If you have any complaints or disputes regarding the Service, please contact the Company directly to attempt resolution. If the dispute cannot be resolved, it will be handled in accordance with Estonian law.

Changes to the Terms

The Company reserves the right to modify these Terms at any time. If there are significant changes, You will be notified at least 30 days before they take effect. Continued use of the Service means You agree to the updated Terms.
